Follow the packet’s signing, witness and identification instructions.
How to complete it
Recording information (top of first page) Enter who prepared the document and the return address. Leave the box on the right blank for the Clerk.
Identify the power of attorney Enter its date, type and every agent and successor agent named. If it was recorded, copy the county, Deed Book and Page.
Sign before a witness AND a notary Signing with a witness and a notary matches the way the original was signed and makes the revocation recordable. Do not sign ahead of time. Need a witness? Our notary can bring one for an additional fee.
Deliver to your agent Give or mail a copy to each agent. The agent may sign the optional receipt at the end, which is useful evidence for filing.
Banks, title companies and other businesses may ask an agent to certify under oath that the power of attorney is still valid before they accept it. This is Georgia’s official optional form for that certification. Once a business requests it, Georgia law gives the business a short deadline to accept a statutory form power of attorney after receiving the certification (O.C.G.A. § 10-6B-20).
An agent is never required to keep serving. This form gives written notice that you are stepping down as agent, coagent or successor agent under a Georgia financial power of attorney, and records who you notified. A notarized resignation is clear proof for banks and successor agents.
A limited (or special) power of attorney lets someone (your “agent”) handle one specific task for you, such as closing a bank account, selling a car, signing for a package or handling a single transaction while you are away. For broad financial authority, use the Georgia Statutory Form Power of Attorney instead. For real estate, use the Georgia Real Estate Power of Attorney, which is formatted for recording.
This form lets someone (your “agent”) sell, buy, refinance or manage one specific Georgia property for you, for example when you cannot attend the closing. Closing attorneys and lenders usually require the power of attorney to be recorded with the deed, so this form follows Georgia recording format: a 3-inch blank space at the top of the first page and room for the return address.
This is Georgia’s official statutory form for naming someone (your “agent”) to handle your financial and legal affairs. It is durable, meaning it stays in effect if you become incapacitated, unless you say otherwise in the Special Instructions. It does not cover medical decisions. For health care, use a Georgia Advance Directive for Health Care.
